Data Terms of Use

These Terms govern the rights and obligations between the User and XSTAGE regarding the use of Data provided by XSTAGE. If the User downloads the Data or begins using it, the User is deemed to have agreed to these Terms.


1. Definitions

  • Data: Motion data provided by XSTAGE (e.g., FBX), related metadata, and any derivatives thereof.
  • Project: One (1) final output such as a game, app, or video.
  • Service: An always-on game, platform, app, channel, or similar service in operation.
  • User: An individual or legal entity that has obtained a license under these Terms.
  • End User: A party who uses the User’s Service.
  • Original Form: A file in an unedited/unchanged state or in a form that can be reverse-extracted (e.g., the original FBX, or a repackaged file of equivalent quality).
  • Motion-Related Revenue: Monetary consideration generated within the User’s Service/platform due to the Data (or motions/emotes/functions/access rights that include the Data), including paid sales, usage fees, and subscription revenue. VAT is excluded, and refunds/cancellations/chargebacks are deducted.


2. Common License Terms

  • Non-exclusive / Non-transferable: The license is non-exclusive and may not be transferred or re-licensed (sub-licensed).
  • Territory / Term: Unless otherwise stated, the license is worldwide and has no time limit.
  • Use and Editing: The Data may be embedded in a Project/Service. Reasonable editing such as retargeting and optimization is allowed.
  • Compliance: The User must comply with applicable laws, platform policies, and rating/classification requirements.
  • No Warranty: XSTAGE does not warrant perfect compatibility with any specific environment or engine.
  • Audit Cooperation: If necessary, XSTAGE may request proof of use (e.g., project name, version, distribution channel), and the User shall cooperate.
  • No Redistribution of Original Form: Sharing/selling/reselling/bundling the Data in Original Form or in any reverse-extractable form is strictly prohibited.
  • No Sub-licensing: Re-licensing to any third party is prohibited.
  • No Standalone Commercialization of Data: Selling the Data itself as a product outside of a Project/Service is prohibited.
  • No Illegal/Improper Use: Any use that violates laws or platform policies is prohibited.


3. License Rights by User Scale and Data Use Scope

3A. User Scale Guide

This section defines user scale and selection criteria applicable to the use of XSTAGE Data. User scale is classified based on usage/operational scale (① motion-related monthly revenue, ② workforce/outsourcing operating model, ③ organizational headcount where applicable). Depending on the selected scale, license fees and scope may differ.

  • Creator: Single-person use, meeting the following criterion:
  • Average motion-related revenue over the most recent 3 months is less than KRW 5,000,000.
  • Studio: A team/studio/small business with 1–10 people, or even a single person if any of the following apply:
  • Average motion-related revenue over the most recent 3 months is KRW 5,000,000 or more;
  • Organizational operating model such as constant outsourcing/partners, or continuous use by multiple operators.
  • Business: An organization with 11–99 people.
  • Enterprise: A large organization with 100+ people.

※ User scale is the basis for pricing and scope determination, and XSTAGE may request reasonable verification of scale.


3B. License Guide by Data Use Scope

1. Single-Basic

  • Scope: One (1) Project; continuous use within a single title/service/character (including updates/patches for the same title).
  • Operators: Single user.
  • Distribution: Live streaming, non-commercial video production, and use as basic motions in paid games are allowed.
  • Restrictions: No offline concerts; no commercial video production.
  • Secondary Sales: Resale of the Data in Original Form is prohibited (common).

2. Multi-Pro

  • Scope: Use in up to five (5) character IPs/services.
  • Operators: Unlimited operators (within the same legal entity/organization).
  • Distribution: Live streaming, commercial/non-commercial video production, and use as basic motions in paid games are allowed.
  • Multi-use (Free): Free use by teams/communities and various end users is allowed (paid resale of the Data itself is not allowed).
  • Secondary Sales: Resale of the Data in Original Form is prohibited (common); free distribution within a Service is allowed.

3. Ultimate

  • Scope: Use in unlimited character IPs/services.
  • Monetization: Paid sale of motions within a game/service is allowed (provided that secondary sale of the original files is prohibited).
  • Royalty Conversion: If the average monthly Motion-Related Revenue over the most recent 3 months is KRW 10,000,000 or more, a separate royalty settlement agreement (purchase order/addendum) is required to continue paid resale/monetization.
  • Settlement Terms: Royalty rate, settlement cycle, whether a minimum guarantee (MG) applies, calculation basis, and evidence requirements shall be set forth in a separate agreement.
  • Cooperation Obligation: If the above threshold is met, the User shall cooperate with XSTAGE’s reasonable requests for revenue evidence and settlement-related materials.
  • Distribution: Offline concert use is allowed.


4. End Users and Partners Policy

  • Seats/Operators: Single-Basic = 1 operator / Multi-Pro & Ultimate = unlimited operators (within the same legal entity/organization).
  • Outsourcing/Partners: Access is allowed only within the Project scope under the User’s direction and supervision. Independent retention, reuse, or distribution of the Data in Original Form is prohibited.
  • Account Security: Account sharing is prohibited. Access must be limited to what is necessary for work purposes.


5. Copyright and Attribution

  • All rights in and to the Data and related materials belong to XSTAGE.
  • The User shall follow XSTAGE’s marking/attribution guidelines.
  • Where third-party IP is involved, the User is responsible for separately securing the relevant rights.

Rights Holder (Copyright Owner) Credit Policy

For K-POP and dance challenge Data, crediting rights holders is recommended where possible.

Recommended example: Choreographer: Seorin, Eram / Artist: BlackPunk

Source Attribution and Anti-Misrepresentation

  • In principle, source attribution (XSTAGE) is not mandatory in outputs.
  • However, where the User posts/provides outputs for commercial promotion purposes—such as (i) soliciting/selling paid commissions (paid production/delivery) or (ii) selling/promoting motions/emotes/functions—the User must clearly disclose, without causing confusion, that the output is based on XSTAGE Data.
  • The User may not use expressions, names, or promotions that may mislead others into believing that the User is the original author/original creator of the Data or substantially identical/similar outputs, and may not register rights or make claims that restrict or mislead third parties’ legitimate use.
  • Recommended label: Base motion source: XSTAGE (https://xstage.co)


6. Updates and Support

  • Update/compatibility/support scope follows the product page or a separate agreement.
  • Performance degradation due to changes in engine/OS/tool versions will be supported within a reasonable scope.


7. Fees, Payment, and Taxes

  • Pricing is determined based on the selected user scale and license type.
  • Payment, exchange rates, and taxes (VAT, etc.) follow store policies or a separate agreement.
  • For overseas payments/offshore transactions, the applicable tax rate (zero-rating/exemption, etc.) follows relevant laws and payment channel policies.


8. Disclaimer and Limitation of Liability

  • The Data is provided “AS IS.”
  • To the maximum extent permitted by law, XSTAGE shall not be liable for indirect, incidental, special, or consequential damages.


9. Termination

  • If the User breaches these Terms, XSTAGE may terminate the license after notice.
  • Upon termination, the User must immediately cease use and destroy the Data and all copies.


10. Refunds and Cancellations

  • Refund criteria after download or commencement of use follow the store refund policy.
  • If a separate agreement provides otherwise, that agreement prevails.


11. Priority and Governing Law/Jurisdiction

  • In case of conflict between these Terms and the product page/separate agreement, the separate agreement prevails.
  • Governing law and jurisdiction follow the purchase order or separate agreement.


Addendum

These Terms take effect on [2026-02-13].

XSTAGE may revise these Terms if necessary and will provide prior notice of changes and the effective date.
